Indian public works increasingly use EPC forms described as transferring construction risk wholesale to the contractor. Read clause by clause, the MoRTH/NHAI model agreement and the Planning Commission model for civil works do something more specific: they transfer design, quantity and ground conditions, keep the correctness of the scope and specifications with the employer, and cap the employer's exposure for late land at a fraction of the contractor's exposure for late completion. This report reads each named form for what it allocates, and where practice here departs from the FIDIC Silver Book.
